“Graduate” Course in Management and Avoidance of Claims to Prevent Their Escalation Into Disputes

Changes occur on all construction projects………this discussion, intended to be interactive, will address five focused issues to allow us to assist our clients in finding solutions before they escalate to be claims that result in litigation/arbitration:

  • The legal need and reasoning for proper and timely notice to preserve and enhance claims and promote responses
  • The focused education and responsibility project management personnel (owner and prime) on proper evaluation of facts and content of submissions and responses to notices of claims
  • Recommendations to promote justifying entitlement and valuation of claimed damages and time and appropriate responses to such requests
  • Suggested methods to address pending issues and notices to avoid the lawyers taking over and the issues becoming formal disputes
  • How to deal with the risks of labor law modification identified in AB 1701 effective 1/1/18

Clients (owners and contractors) are faced with many contractual issues throughout projects and notices of claims trend towards creating schisms and promoting discord. Then the lawyers get involved and the time and costs to resolve tend to escalate. Suggestions on practical solutions to issues that arise on every project will be the focus of the discussion.
